Reporting Copyright Infringements

If you believe in good faith that your copyrighted work has been copied and posted on PHOENIX in a manner that constitutes copyright infringement, you can provide our copyright agent the written information specified below via the Help Center or via an email to verizontal.phx@gmail.com.

Remember that only the copyright owner or their authorized representative can file a report of copyright infringement.

To submit a DMCA takedown notice of claimed copyright infringement, you will need to provide us with the following information:

A physical or electronic signature (typing your full name will suffice) of the copyright owner or a person authorized to act on their behalf;
Your contact information, including your address, telephone number, and an email address;
Identification of the copyrighted work claimed to have been infringed (e.g., a link to your original work or clear description of the materials allegedly being infringed upon);
A description of where the material that you claim is infringing is located on PHOENIX;
A statement that you have a good faith belief that the use of the material in the manner asserted is not authorized by the copyright owner, its agent, or the law;
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Please note that we may share a full copy of your report, including your name, contact information, the name of the rights holder (in the case that you are an authorized representative) and the other contents therein to the person who posted the content you are reporting.

Please aware that filling a DMCA takedown notice of claimed copyright infringement is a serious matter. Knowingly submitting a false report, including intentional misrepresentation regarding infringing content or action, or otherwise misusing this process may result in liability for damages and/or other legal consequences under the applicable laws.

As per our Terms, we have the right to restrict, suspend, freeze or terminate the account of user who infringes or is alleged to have infringed the legal rights and interests of the others by using our services.

Submitting a Counter-Notice

Copyright-protected content can be removed or disabled if it was posted, used, or distributed using PHOENIX resources without the copyright owner’s permission.

If you believe that your content on PHOENIX was removed or disabled pursuant to a DMCA takedown notice by mistake or due to misidentification of the content, you can contest the takedown by submitting a counter-notice to our copyright agent at verizontal.phx@gmail.com.

To submit a counter-notice, you will need to provide us with the following information:

the following statement: "I have read and understand PHOENIX’s COPYRIGHT POLICY." We won't refuse to process an otherwise complete counter notice if you don't include this statement; however, we will know that you haven't read this policy and may ask you to go back and do so;
A physical or electronic signature (typing your full name will suffice);
Your full name, email address, physical address (including country), telephone number;
Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before that removal or disabling;
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

Upon receipt of a valid counter-notice, we will promptly forward a copy to the person who filed the original notice. This means that the contact information that is submitted in your counter-notice will be shared to the person who filed the original notice.

If the copyright owner disagrees that the content was removed in error or misidentification, they may pursue legal action against you. If we do not receive notice within 10 business days that the original reporter is seeking a court order to prevent further infringement of the material at issue, we may replace or cease disabling access to the material that was removed.

Please think twice before submitting a claim or counter-notice, especially if you are unsure whether you are the actual rights holder or authorized to act on a rights holder’s behalf. There are legal and financial consequences for fraudulent and/or bad faith submissions. Please be sure that you are the actual rights holder, or that you have a good faith belief that the material was removed in error, and that you understand the repercussions of submitting a false claim.
